CDD Easements
The plats usually grant access over, under and across all access and/or drainage easements to the CDD and any County/CDD/HOA/SJRWMD-authorized custodial/maintenance entities. As such, homeowners who wish to install fencing, structures, or landscaping that may encroach on any easement within their property must first obtain CDD approval. Any easement obstructions may be removed at homeowner's expense if it interfers with the CDD or authorized entity's access to CDD infrastructures including, but not limited to, stormwater ponds, common areas, and/or conservation areas adjoining a property and/or underground stormwater and utility systems within the easement.
To find out if your property contains a drainage or access easement, you can view the recorded plat that corresponds to the PB [plat book] and PG [page] listed in the property description found on your Property Record Card.
The completed Easement Encroachment agreement with required supporting documents can be sent to District staff using one of the links below. The Board will approve/deny a request during a regular meeting based on the District Engineer's recommendation. If approved, the District Manager will forward the executed agreement to the email supplied by the requester once any required payments for processing are deposited.
